Terms of Service & Disclaimer

1 Introduction

These Terms of Service ("Terms") govern your use of the MiaoSense mobile application ("App") and the website miaosense.app. MiaoSense is developed and operated by Purrception, operated by Robert Sommer, Isoldenstraße 26, 80804 Munich, Germany ("we", "us", or "Purrception").

By installing, accessing, or using the App, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must not use the App.

2 Acceptance of Terms

MiaoSense presents these Terms during its first launch in an onboarding screen that requires your explicit confirmation via a checkbox before the App becomes functional. This constitutes your legally binding acceptance of these Terms.

A consent record — including the timestamp, Terms version, app version, and your device locale — is stored locally on your device in accordance with Art. 7(1) GDPR.

You must be at least 16 years old to use MiaoSense. By accepting these Terms, you confirm you meet this age requirement.

3 Description of the App

MiaoSense is an on-device AI application for Android that uses your device's camera and microphone to observe your cat's posture, body language, and vocalisations. The App generates behavioural indicators that describe observable patterns in your cat's posture, movement, and vocalisations.

Key characteristics of the App:

• On-device processing only — all AI inference runs locally on your device
• No data transmission — no video, audio, or behavioural data is ever transmitted to Purrception or third parties
• Offline operation by default — no internet connection is required for core analysis; the optional MiaoWatch remote camera feature requires a network connection to the camera
• Observational only — all outputs describe patterns observed; MiaoSense does not provide recommendations or advice on how to act

MiaoSense may in future offer optional paid features (in-app purchases). Any such features will be clearly labelled, and separate consent or purchase steps will apply.

4 Disclaimer: AI Outputs

MiaoSense uses artificial intelligence models to observe your cat's behaviour and to derive behavioural indicators from it. The analyses, scores, and indicators the App provides are AI-generated estimates for informational purposes only.

AI-based assessments are inherently probabilistic and may be inaccurate. Factors that can affect reliability include:

• Lighting conditions and contrast
• Camera distance and angle
• Unusual or obscured body postures
• Background noise or ambient sound
• Device camera and microphone quality

Outputs may vary between sessions even under identical conditions, as AI models produce probabilistic results. The App's assessments do not constitute a medical, scientific, or veterinary opinion.

5 Not a Substitute for Veterinary Advice

Always consult a licensed veterinarian for any health concerns about your cat. Do not delay or withhold veterinary care based on the App's outputs. If your cat shows signs of distress, injury, or illness, seek professional veterinary attention immediately.

MiaoSense is not a medical device and has not been evaluated or approved by any regulatory authority for veterinary or medical use. It is an information tool for end users only — private or, in accordance with Section 9a, commercial.

6 Limitation of Liability

To the fullest extent permitted by applicable law, Purrception (Robert Sommer) shall not be liable for any direct, indirect, incidental, consequential, or special damage, harm, or loss arising from or in connection with:

• the use or inability to use the App;
• reliance on AI outputs, scores, or indicators provided by the App;
• delays in or decisions against seeking veterinary treatment based on App readings;
• misinterpretation of behavioural indicators;
• technical errors, interruptions, or inaccuracies in AI analysis.

For slightly negligent breaches of essential contractual obligations (cardinal obligations), liability is limited to foreseeable, contract-typical damage.

Nothing in these Terms excludes or limits our liability for:

• death or personal injury caused by any degree of negligence, wilful misconduct, or intent on our part;
• any other damage caused by our wilful misconduct or gross negligence;
• fraud or fraudulent misrepresentation;
• liability under the product liability law applicable to you — EU Directive 2024/2853 and the national laws implementing it, for Germany the Produkthaftungsgesetz (ProdHaftG), including the version applicable from 09 December 2026;
• any other liability that cannot be excluded or limited under applicable mandatory law.

Where liability cannot be entirely excluded, it is limited to foreseeable, typical damage at the time of contracting.

7 AI Transparency

MiaoSense uses artificial intelligence (machine learning). We inform you that:

• The App employs machine learning models (computer vision and audio classification) to generate behavioural assessments of cats.
• All AI processing occurs locally on your device (on-device processing); no data is transmitted to AI providers.
• The AI outputs are probabilistic estimates, not factual determinations.
• MiaoSense analyses feline facial expressions and behaviour — not human emotions and not biometric data of persons.
• MiaoSense makes no automated decisions about people.

All AI models run on your device via the ONNX/TFLite runtime.

8 Privacy & On-Device Processing

MiaoSense is designed with privacy as a core principle. All analysis — including camera processing, audio analysis, and behavioural scoring — runs exclusively on your local device. No personal data, cat data, video, or audio is transmitted to Purrception or any third party.

Data stored locally on your device includes:

• Cat profiles (name, breed, age, notes) you create within the App
• Analysis session results
• Your consent record (timestamp, Terms version, app version, device locale)
• App preferences (theme, language, sensor settings)

You can export or permanently delete all locally stored data at any time via the App's Settings screen, in exercise of your rights under Art. 17 (right to erasure) and Art. 20 (right to data portability) GDPR. As all processing is on-device, no international transfer of personal data within the meaning of Chapter V GDPR occurs in the ordinary course of App operation.

8a User-Generated Analysis Media

The App allows you to create and save analysis photos and vocal recordings ("analysis media") on your device. The following terms apply specifically to your use of this feature.

8a.1 Disclaimer Label

All exported analysis media include a visible disclaimer label ("MiaoSense — not a vet substitute") burned into the file. This label may not be cropped or obscured in a way that misleads recipients about the informational nature of the content.

8a.2 Sharing Responsibility

When you share analysis media with third parties, you bear full responsibility for complying with applicable data protection law and criminal law, including:

• § 201a StGB (Germany) — unauthorised recording or sharing of images of persons in private spaces may be a criminal offence punishable by up to two years' imprisonment. In Austria: § 120 StGB; in Switzerland: Art. 179quater StGB. In other EU jurisdictions equivalent national criminal-law provisions apply.
• General data protection obligations under the GDPR where third parties are identifiable in shared recordings.

Before sharing any analysis media, you must ensure that no identifiable persons are visible in the recording. Purrception is not liable for any damages arising from your sharing of analysis media with third parties.

8a.3 On-Device Storage

Analysis media are stored exclusively on your device. Purrception does not receive, process, or access any exported media files. You can delete saved media at any time through your device's gallery app or file manager.

9 Intellectual Property

MiaoSense is a trademark applied for at the German Patent and Trade Mark Office (DPMA), Application No. 30 2026 224 539.0, covering classes 9 and 42. All rights are reserved.

All content within the App and on miaosense.app — including but not limited to software, design, graphics, text, and AI models — is owned by or licensed to Purrception (Robert Sommer) and is protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for your personal, non-commercial purposes in accordance with these Terms; if you use the App commercially or professionally, Section 9a applies in addition. You may not:

• copy, modify, or distribute any part of the App or its content;
• reverse-engineer, decompile, or disassemble the App;
• use the MiaoSense name or trademarks without our prior written consent.

9a Commercial and Professional Use

Notwithstanding the restriction in Section 9 to personal, non-commercial purposes, we permit you to use MiaoSense in the course of a commercial or independent professional activity within the meaning of § 14 BGB (“commercial use”), in particular by veterinary practices, cat boarding facilities and hotels, cat cafés, animal shelters, and comparable organisations, provided that you comply with the following conditions.

9a.1 Scope of the licence

Where you use the App commercially, the licence granted under Section 9 extends to use of the App within the operations of your organisation, including the observation of cats that are not your own — patients, boarding guests, visiting cats, or animals in your care as a shelter. All other restrictions in Section 9 remain unchanged, in particular the prohibition on reverse-engineering, copying, or using our trademarks without our prior written consent.

9a.2 Observational only — no diagnosis, no triage

You must ensure that the people who use the App in your organisation are aware of this restriction and characterise its outputs to third parties in line with Sections 4 and 5.

9a.3 Reach of the licence: one organisation, one site

A purchased licence covers use of the App within one organisation at one site — regardless of how many devices or accounts it is used on there. A site, for the purposes of these Terms, is a physically contiguous business location at a single address. Further locations at a different address — including branches, satellite practices, and franchisees of the same company — each require their own licence.

9a.4 Data protection — your responsibility

If you use MiaoSense to observe cats you do not keep yourself, and you enter personal data into the App in doing so — names or contact details in cat profiles or notes, for example — you are the controller within the meaning of Art. 4(7) GDPR for that data. Because all processing takes place exclusively on your own device and Purrception never has access to it, Purrception does not process any personal data on your behalf; a data processing agreement under Art. 28 GDPR is therefore not required for the use of MiaoSense. Your own obligations towards your customers, clients, or patients — such as the information duties under Art. 13 GDPR — remain unaffected and rest with you alone.

9a.5 Liability in commercial use

If you act as an entrepreneur within the meaning of § 14 BGB when using MiaoSense, the following applies under § 310(1) BGB in addition to Section 6: our liability for slightly negligent breaches of non-essential contractual obligations is excluded. For slightly negligent breaches of essential contractual obligations, liability is limited to the foreseeable damage typical of this type of contract. The exceptions listed in Section 6 — in particular intent, gross negligence, damage arising from injury to life, body, or health, and mandatory liability under the product liability law applicable to you — remain unaffected.

9a.6 What counts as commercial use

Commercial or professional use within the meaning of this Section 9a means using the App in the course of a commercial or independent professional activity within the meaning of § 14 BGB. If you also, or exclusively, use the App privately for your own cat, Section 9 and the remaining provisions of these Terms continue to apply to that use unchanged.

10 Changes to These Terms

We may update these Terms from time to time. We amend them only where there is a valid reason to do so — such as a change in the law or in case law, technical development, or new features of the App. Amendments do not affect the scope of features you have already purchased.

Amended Terms apply to you only once you have accepted them. The App presents the amended version at the next launch and asks for your acceptance. There is no tacit acceptance — neither by continued use nor by silence.

If you do not accept, you cannot continue using the App. You can export or delete the data stored on your device beforehand, in the App settings.

The current Terms are always accessible at miaosense.app/terms. The version number is shown at the top of this page.

11 Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict-of-law provisions. The UN Convention on Contracts for the International Sale of Goods (CISG) does not apply.

To the extent permitted by law, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms and the use of the App is Munich, Germany (Landgericht München I).

If you are a consumer resident in the European Union, you retain the benefit of any mandatory consumer protection provisions of your country of residence that cannot be excluded by contract (Art. 6(2) Rome I Regulation).

13 MiaoWatch — Remote Camera Feature

MiaoWatch is an optional feature that allows you to connect MiaoSense to a remote camera stream (e.g. an IP camera or webcam) via a URL you provide. The following terms apply specifically to your use of this feature.

13.1 Authorisation and Responsibility

By activating MiaoWatch and entering a camera URL, you confirm that you are legally authorised to access and monitor the camera stream you connect to — whether as the owner or as a person who has received explicit, documented permission from the owner and from all persons who may be captured by the camera. You must not use MiaoWatch to access cameras without such authorisation. Any unlawful use of MiaoWatch is exclusively your legal responsibility; Purrception accepts no liability for damages arising from your unlawful or unauthorised use of the feature.

13.2 Limitation of Liability

To the fullest extent permitted by applicable law, Purrception accepts no liability for:

• the availability, continuity, or quality of any camera stream you connect to;
• the content of such streams;
• any legal consequences arising from your use of MiaoWatch, including claims under data protection, privacy, or criminal law brought by third parties whose image may be captured;
• any data protection violations for which you, as the person operating the stream, are the responsible party under applicable data protection law.

This limitation does not apply to damages caused by Purrception's wilful misconduct or gross negligence, nor to liability for injury to life, body, or health. The general limitation of liability in §6 applies in addition to this clause.

13.3 Supported Protocols

MiaoWatch supports MJPEG, RTSP, HLS and progressive video files, over both HTTP and HTTPS. The address you enter may be inside your own network or on the internet. Where the address is outside your own network and the connection is not encrypted, the App asks you to confirm before connecting. Unsupported protocols or misconfigured URLs may result in a failed connection; no data is transmitted in such cases.
